1. Purpose

NowHub (hereinafter, "the Platform" or "NowHub") provides a real‑time communication and engagement service that centralises announcements, launches and live status updates for distribution across multiple channels. These Terms govern access to and use of the Platform by natural or legal persons who register (hereinafter, "the User").

2. Acceptance and scope

Access to and use of the Platform implies full and unconditional acceptance of these Terms of Service.

NowHub reserves the right to modify, suspend or withdraw features, prices or conditions at any time, with immediate effect, without giving rise to any compensation or indemnity for the User.

3. Registration and account

To use the Platform the User must create an account by providing, at a minimum, an email address, first and last name and any other data requested.

The User is responsible for maintaining the confidentiality of their credentials and for all activities performed under their account. NowHub is not liable for unauthorized access resulting from the User's negligence.

4. Permitted use and User obligations

The User agrees to use the Platform in accordance with the law, public order and accepted moral standards, and not to use it for illegal, defamatory purposes, to infringe third‑party rights or to engage in spam or abusive behaviour.

It is prohibited to introduce malicious software, false data or to perform activities that may damage, overload or interfere with the Platform. NowHub may limit, suspend or terminate accounts that breach these obligations.

5. Intellectual property

NowHub and/or its licensors own all intellectual and industrial property rights in the Platform, its design, code, trademarks, content and documentation.

The User is granted only a limited, non‑exclusive, non‑transferable and revocable licence to use the Platform in accordance with these Terms. Reproduction, distribution, reverse engineering or unauthorised exploitation is prohibited.

6. User content

The User retains ownership of the content they publish through the Platform, but grants NowHub a worldwide, royalty‑free, non‑exclusive and sublicensable licence to store, reproduce, display and distribute such content in connection with the provision of the service.

The User represents and warrants that they hold the necessary rights to the content they publish and that its publication does not infringe third‑party rights.

7. Limitation of liability

Except in cases of wilful misconduct or gross negligence by NowHub, NowHub's liability for direct damages arising from the use of the Platform shall be limited in aggregate to the amount actually paid by the User for the service in the three (3) months preceding the event giving rise to the damage.

NowHub shall not be liable for: service interruptions due to external causes (e.g., Internet failures, third‑party providers, force majeure), loss of User data, loss of profits, reputational damage, or indirect, special or consequential damages.

The Platform is provided "as is", without guarantees of uninterrupted availability, error‑free operation or fitness for a particular purpose. NowHub offers no warranties other than those legally mandatory.

8. Prices and refunds

Prices and payment methods shall be set out on the subscription page or in the corresponding invoice.

Except as may be mandatory under applicable law, NowHub shall not be obliged to refund amounts for cancellation, service interruption or removal of features, nor to pay compensation for such events.

9. Term and termination

The contract shall have the duration agreed at the time of subscription. Either party may terminate the contract for material breach by the other party after prior notice and, where applicable, a reasonable cure period.

NowHub may suspend or cancel accounts and content that violate the law or these Terms without liability.

These Policies and the Terms constitute the entire agreement between the parties regarding the use of the Platform and supersede any prior agreements.

If any provision of these documents is declared null or unenforceable, the remaining provisions shall remain in full force and effect.

10. Data protection

The processing of personal data arising from registration and use of the Platform is described in the accompanying Privacy Policy, which the User acknowledges having read and accepted.

11. Modifications

NowHub may update these Terms and Policies and will publish the current version on the Platform; the User's continued use after publication constitutes acceptance of the changes.
